Courtroom Testimony: A Prepared Police Officer Will Win The Case

Making a good arrest is only the initial step in getting a criminal off the street. To keep a criminal off the street, a police officer must testify in court. An officer’s performance in the courtroom can largely determine what a judge or jury may decide. Courtroom testimony is one of the more important skills for a police officer to learn, but few officers are given any formal training regarding being a good witness. So here are a few things to consider before you are called to the stand in your next trial.

A jury is likely to consider you a more credible witness if you appear prepared. Spending a lot of time on the stand searching through your notes, because you failed to refresh your memory prior to the trial does not improve your standing with the judge or jury.

If possible, go over the case with the prosecutor several days before the hearing, deposition, or trial. This allows you and the prosecutor to establish a professional rapport prior to taking the stand. Additionally, the prosecutor can tell you what areas of your testimony the defense is likely to attack.

When on the stand, carefully listen to the attorneys’ questions. Wait until the question is complete before you start to answer. Always answer the question completely, but do not volunteer information. Running on at the mouth will rarely benefit your case.

Nonverbal communication is also very important when testifying. Dress appropriately for court. Make sure your brass is polished and your boots are shined. Make eye contact with the jurors when being sworn in and when answering questions. Sit erect and maintain a professional appearance.

With the proper preparation, a police officer will give very credible testimony and help remove a criminal from society.
